Capitalised
terms used in this Privacy Policy and not otherwise defined herein shall have
the meaning set forth in the Terms of Use which are available on the Website.Â
In the event of any inconsistency between the terms in this Privacy Policy and
the Terms of Use, the terms of this Privacy Policy shall prevail.
This Privacy Policy is intended to
inform you of Linkory.com's policies and practices regarding the collection,
use, disclosure and sharing of any personal information you submit to us
through www.linkory.com or its directly associated domains  (hereinafter
referred to interchangeably as "Linkory.com or the "Website"). Personal
information is information relating to you as an individual and from which you
can be identified, such as your name, address, email address or telephone
number. Registered users are able to change their profile information at any
time and may control how other users and the service communicates with them.
This Privacy Policy applies solely to
the services owned and operated by Memory Highway Ltd. and we are not
responsible for the privacy practices of other websites. When linking to other websites,
we urge you to review the privacy policies of those sites.
Please note that that this Privacy
Policy does not apply to information posted in public areas of the Linkory
Website by either you or any other user. We strongly advise users not to
disclose personal or contact information within these public areas that they do
not wish to share. This information should be maintained in the
appropriate contact information section of this site, which is protected under
the terms of this Privacy Policy.
By accessing or using Linkory.com
you accept the practices outlined in this Privacy Policy. This policy may change
over time as discussed below.
WHAT PERSONAL INFORMATION ABOUT
USERS DOES LINKORY.COM COLLECT?
You do not have to register with
Linkory.com in order to view content posted by other users. However, certain
activities such as posting content, uploading images, viewing restricted
content or contacting friends require that you register on the Website. During
the process of creating a Linkory.com account, we request some personal
information such as your email address and a password, which is used to protect
your account from unauthorized access. In addition, we ask for your first and
last names as well as your birth date, which is used to verify that registrants
are at least 13 (thirteen) years of age. We may also collect demographic
information, such as your home address, telephone number, gender, occupation
and interests. This demographic information is optional and is not compulsory
in order to complete the registration process.
Linkory.com automatically collects
usage information whenever you interact with us, including your IP address,
pages browsed and cookie information. If you are logged in, we may record the
groups that you subscribe to, the friends and contacts that you communicate
with and the patterns of your contributions. Linkory.com may associate this
information with your account.
All User Content (as defined in the
Linkory.com Terms of Use) is posted on the site at your own risk. We strongly advise
users not to disclose any personally identifiable information such as your
email address, telephone number or street address within these public
areas. This information should instead be maintained in the appropriate user
profile section of this site, which is protected under the terms of this
Privacy Policy. Linkory.com allows users to set privacy options that limit
access to submitted User Content. However no security measures are impenetrable
and we cannot guarantee that this User Content will not be viewed by
unauthorized persons. Any User Content removed from the site by you, other
users with whom you communicate or by Linkory.com may remain viewable in cached
and archived pages or if others have copied or stored this content.
We cannot control the actions of
other users of the Website with whom you may choose to share your personal
information and therefore any personal information that you voluntarily
disclose on Linkory.com whether in the public areas of the Website or in your
profile (including all submitted content and images) may become publicly
available and thus collected and used by others.
HOW IS THIS INFORMATION USED?
When you register with Linkory.com,
you create your own profile and privacy settings. Personally identifiable
information submitted during this registration process is used to operate and
maintain the Services, as well as to provide you with the features and
functionality of the site. We may occasionally use your name and email address
to send you updates, newsletters or notifications regarding new services
offered by Linkory.com.
Linkory.com facilitates social sharing
of memories between friends. Your name and profile picture thumbnail will be
available in search results within Linkory.com and this information may be made
available to third party search engines. Limited profile information (your full
name, profile picture, as well as your activities on the site) are displayed to
users who are designated to be your friends. Your email address is not displayed
when others view your profile. Users who see your name when viewing User
Content or in searches will not be able to access your profile information
unless they have a relationship with you (friend, member of your group, etc.)
that permits such access based on your privacy settings.
When you submit User Content, you
are given a choice on how your name is to be displayed to other users when they
view this content. Either your full name (first and last name) is displayed, or
your first name plus the first letter of your last name will be displayed. No
other personally identifiable information (such as your email address) is
shown.
Linkory.com members may invite other
users to become friends or to view submitted User Content. In addition, users
may wish to contact the author of any User Content viewed. These features are
facilitated by sending emails via our automated system. Your full name will be
included in such an outgoing email, but other personally identifiable
information (such as your email address) will not be shown. This also implies
that you may receive service-related announcements through the general operation
of Linkory.com. For instance, if another registered user requests that you
become a friend, you may receive an email alerting you to that fact.
When issuing invitations, we may
ask you for your friend's email address so that we may automatically issue an email
inviting him or her to visit the site. Linkory.com stores this information in
order to send this one-time email and to complete a friend connection if your
invitation is accepted. Recipients of invitations from Linkory.com may contact us
to request the removal of their contact information from our database.
WILL LINKORY.COM SHARE ANY OF THE
INFORMATION THAT IT RECEIVES?
Linkory.com may use your email
address and other personally identifiable information without further consent
for non-marketing or administrative purposes, such as for customer service and
notifications of changes to the Website.
We may provide aggregated data
about the usage of our services to third-parties for such purposes as we deem,
in our sole discretion, to be appropriate. This aggregate information is not
traceable to any identifiable Linkory.com user and is typically in the form of
statistics such as gender, the number of users who fall within a particular age
group or those who live in a particular geographic area.
Linkory.com
uses ad serving technology and other third-party advertising companies to serve
ads when you visit our Website. These companies may use information in
your profile (not including your name, address, email
address or telephone number) without identifying you as an individual. Third
parties may be provided with information such as your IP address, your Internet
Service Provider (ISP) and specifics regarding your visits
to this and other websites. To this end, advertisers are able to provide
content on the Website about products and services that may be of specific
interest to you. Note that by interacting with or viewing an advertisement on
the Website, you are providing consent that the advertiser may assume that you
meet the targeting criteria used to display the advertisement.
We may ask
you for personally identifiable information at our sole discretion, including,
but not limited to, when you enter contests, promotions or sweepstakes
sponsored by Linkory.com or by a third party, or when taking surveys and polls.
It is important to remember that participation is entirely optional and you
have no obligation to respond. However, if you do choose to participate, we may
share your personally identifiable information with third parties involved in the
specific program or feature so they can contact
you.
We may provide your personal
information to third parties, who provide services on our behalf and assist in
facilitating our business. These companies may be used for, but are not
limited to, hosting of the Linkory.com services, handling the processing and
delivery of electronic mailings, providing search results or links to other websites,
performing statistical analysis of our services and providing customer support.
Such third parties will be permitted to obtain only the personal information
they need to deliver the required service, but they will not have any
independent right to share this information.
Linkory.com will disclose your
personally identifiable information if we reasonably believe we are required to
do so by law, regulation or other government authority or pursuant to lawful
requests such as subpoenas or court orders. In addition, we may disclose
information if we believe it is necessary in order to protect our interests or
property, defend against legal claims, investigate, prevent, or take action
regarding suspected illegal activities or fraud, in situations involving potential
threats to the physical safety of any person, or violations of Linkory.com's
Terms of Use or Privacy Policy. This may include sharing information with other
companies, lawyers, law enforcement agencies or government agencies.
COOKIES, WEB BEACONS AND
INFORMATION COLLECTED VIA TECHNOLOGY
Like most websites, Linkory.com
employs standard Internet technologies to provide useful features to their users,
to analyze trends and improve the services provided.
As you navigate the Website,
certain information may be passively collected and stored on our servers,
including your Internet protocol (IP) address (or the address of the proxy
server you use to access the World Wide Web), the name of your ISP, your type
of web browser, your computer operating system and the pages that you visited
at Linkory.com. We also automatically receive the URL of the site from which you
came and the site to which you are going when you leave Linkory.com.

to provide useful features to their users. Linkory.com uses cookies to store
visitors' preferences and to record session information in order to provide you
with a more personal and interactive experience on the Website. Both session
Cookies (which expire once you close your web browser) and persistent Cookies
(which stay on your computer until you delete them) may be used.
Most browsers are initially set up
to accept cookies. However, if you prefer, you may be able to configure your
browser to accept or reject all or some cookies, or notify you when a cookie is
sent. We strongly recommend that you leave the cookies activated, as this will
allow you to take full advantage of the Linkory.com Website. We do not combine the
information stored in cookies to any personally identifiable information that you
have submitted on our site.
When you visit the Linkory.com
website, your computer may receive cookies from third parties who are
presenting advertisements on some of our pages, and from other sites displayed
as search results or links. This Privacy Policy covers the use of cookies by
Linkory.com and does not cover the use of cookies or other tracking
technologies by any third party, such as advertisers. Other companies' use of
their cookies is subject to their own privacy policies, not the Linkory.com Privacy
Policy.
Linkory.com also uses web beacons - sometimes
called action tags or single pixel gifs - to access cookies inside and outside
our Web pages. This allows us to compile aggregated statistics and to deliver
co-branded services. We may also use web beacons in emails sent to our users,
to let us know whether and when the email was opened and acted upon. No
personal information is transmitted through web beacons.
SECURITY OF YOUR PERSONAL
INFORMATION
Linkory.com is committed to
protecting the security of your personal information and we employ diligent efforts to protect the security and integrity of the
information you provide to us once it is received on our systems.
We restrict access to your personal
information to employees and third parties who we reasonably believe need such access
in order to perform their job functions and to provide products or services to
you. No company is able to fully eliminate security risks associated with stored
data. Therefore, Linkory.com cannot guarantee the security of this personal information.
Linkory.com member accounts are protected
by member-created passwords. Please do not disclose your account password to any
third party or permit any third party to access your account.
Note that email and instant
messaging are not recognized as secure communications. Therefore, please do not
send private information via these media. In addition, we strongly advise users
not to disclose any personally identifiable information in public areas of the
Website.
EDITING AND DELETING YOUR ACCOUNT
INFORMATION AND PREFERENCES
Linkory.com users may modify,
correct or delete their personal information at any time by logging into their
account and accessing the "My Profile" Web page. Modified information will be
updated immediately.
Users who wish to deactivate their
Linkory.com account may do so by visiting the "My Profile" Web page, selecting
'Deactivate Account' and following the simple instructions. Removed personal
information may persist in our data base but will not be available to other
members of Linkory.com. Please note any User Content previously posted cannot
generally be removed.
YOUR CHOICES
Linkory.com offers two distinct
types of activity; non-account activity where you are able to view public User
Content without having a Linkory.com account, and account-related activity
where a user account must be created in order to fully participate in the
features of this Website. You may decline to submit personally identifiable information
to Linkory.com in order to create a user account, in which case you will be
limited to non-account activities.
Linkory.com is all about sharing memories
with others, while providing you with optional privacy settings that define restrictions
on how other users may access and add to your User Content. When you create a
memory, there are three distinct options for defining the privacy of and access
to this memory:
•
Make my memory accessible to all - The memory title, memory
content and attachments are searchable and viewable by all users. Anyone may
add to your memory and share you memory with others.
•
Limit access to my
memory - The memory title, memory content and attachments are
searchable and viewable by all users. However, only the friends you invite are
able to add to your memory. Anyone may request to add to your memory, but you
are free to grant or refuse permission.
•
Make my memory private -
The memory title is searchable by all users, but no User
Content is viewable. Only friends that you invite may view, share or add to the
memory.
You may modify your personal
profile information and preferences at any time by visiting your account
profile page. In addition, you may deactivate your account and limit your
access to non-account activities.
As explained earlier, you are
generally able to configure your browser to reject cookies or tell you when a
cookie has been sent. If you choose to decline cookies, then you will not be
able to take full advantage of Linkory.com's services and interactive features.

PERSONAL INFORMATION
Children under the age of thirteen
(13) are prohibited from using Linkory.com. Therefore, we will not knowingly

allow such persons to register for the Services. In the event that we learn

Furthermore, we recommend that minors over the age of 13 ask their parents for
permission before registering at Linkory.com.
